The rules for using the DigiDoctor.app app, website and patient portal. The short version: we are the software your clinic runs. We are not your doctor, and we never give medical advice.

Who this is between

These terms are an agreement between you and [LEGAL ENTITY NAME] ([CIN]), registered at [REGISTERED ADDRESS], which operates DigiDoctor.app.

By creating an account, booking an appointment or using the app, you accept these terms. If you do not accept them, do not use the service. They are an electronic record under the Information Technology Act, 2000 and need no signature.

What DigiDoctor.app is

DigiDoctor.app is software that clinics in India use to manage appointments and patient records. The app gives you your side of that: your bookings, your prescriptions, your reports.

We are not a hospital, a clinic, a pharmacy, a diagnostic lab or a healthcare provider of any kind. We do not employ doctors and we do not practise medicine. Your care is provided by the clinic you visit, and your relationship as a patient is with that clinic and its doctors, not with us.

We are also not a directory or a marketplace. We do not rank doctors, recommend one over another, or take a commission on your treatment. You can only use DigiDoctor.app with a clinic that already uses it.

Not medical advice

Nothing in the app is medical advice. What you see is a record of what your clinic wrote down, shown back to you.

  • Do not start, stop or change any medicine based on what you read in the app. Ask your doctor.
  • A prescription in the app is a record of what was prescribed at the time. It is not a standing authority to keep taking that medicine.
  • A report in the app is not a diagnosis. Only your doctor can interpret it.
  • If what the app shows does not match what you were told, believe your doctor and tell the clinic there is an error.

Emergencies

Do not use this app in an emergency. It is not monitored, and nobody is watching it for urgent messages. In a medical emergency call 112, or go to the nearest hospital.

Your account

  • You must be 18 or older to hold an account. A parent or legal guardian can hold one on behalf of someone younger.
  • Give accurate details. A wrong date of birth or blood group in a medical record is dangerous, not a formality.
  • Keep your password to yourself. You are responsible for what happens under your account.
  • Tell us at once if you think someone else has got into your account.
  • One account per person. Do not register under someone else’s name.

We may suspend an account we reasonably believe is being misused, is impersonating someone, or is putting other people’s records at risk.

Booking for family

You may book and manage appointments for a family member — a parent, a child, a dependant — where you are entitled to act for them. Each patient has their own record, so the appointment must be under the name of the person who is actually being seen.

By booking for someone else you confirm you have their permission, or the legal authority to act for them. [CONFIRM: what the app actually supports today]

Appointments

  • A booking is a request to the clinic. The clinic confirms, reschedules or declines it. We do not control a doctor’s availability.
  • Clinics run late. A slot is an intended time, not a guarantee.
  • Cancellation and no-show rules are set by your clinic, not by us.
  • A clinic may cancel or move an appointment. Where we can, we will tell you through the app.
  • Reminders are a convenience, not a commitment. Do not rely on one arriving — a message can fail to be delivered for reasons outside our control.

Fees and payment

The app is free for patients. Clinics pay for DigiDoctor.app; you do not. [CONFIRM THIS IS AND WILL REMAIN TRUE]

Consultation fees and charges are set by your clinic and paid directly to the clinic. We do not process payments, do not hold your money and take no cut. Invoices you see in the app are issued by the clinic. Refunds and billing disputes are between you and the clinic.

Your records

Your clinical record is created and controlled by your clinic. We store it on the clinic’s behalf.

  • You can view and download your own records through the app.
  • To correct a clinical entry, ask the clinic. We are not permitted to alter a doctor’s entry, and you would not want a software company that could.
  • Your records start from when your clinic joined DigiDoctor.app. Older paper records exist only if the clinic adds them.
  • If your clinic stops using DigiDoctor.app, its records go with it. We will give you a reasonable way to export your own copy first. [DEFINE THE EXPORT WINDOW]

Acceptable use

Do not:

  • Try to reach anyone else’s records, or any part of the system you have not been given access to.
  • Probe, scan, scrape or reverse-engineer the service, or get round any security or rate limit.
  • Upload malware, or anything unlawful, abusive or infringing.
  • Impersonate a patient, a doctor, a clinic or us.
  • Use the service to send spam, or for any purpose other than your own care and that of people you are entitled to act for.
  • Resell, sublicense or commercially exploit any part of the service.

Attempting to access another patient’s medical record is a serious matter. Access is logged, and we will suspend the account and report it to the authorities where appropriate.

Our software

The app, this website, our name, our logo and everything in the service belong to us or our licensors. You get a personal, limited, non-transferable, revocable licence to use the app for its intended purpose. Nothing else is granted.

Your medical data is not ours. We claim no ownership of your records and do not license them to anyone.

Availability

We try to keep the service running, but we do not promise it will always be available. It may go down for maintenance, faults, or things outside our control such as network or power failures.

We may add, change or withdraw features. If we withdraw something you depend on, we will give reasonable notice where we can.

Disclaimers

To the extent the law allows, the service is provided “as is”, without warranty of any kind.

We are not responsible for the medical care you receive, the accuracy of what a clinician records, a clinic’s conduct, its fees, its cancellation policies, or any dispute between you and your clinic. Those are matters between you and the clinic.

Nothing here excludes liability that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.

Limits on liability

To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss of data caused by something outside our reasonable control.

Where we are liable, our total liability to you is capped at [AMOUNT — note the app is free to patients, so counsel should advise what a meaningful cap looks like].

This does not limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Ending your account

You can close your account at any time from the app or by writing to us. Closing it removes your login and app data.

Closing your account does not delete your medical record. Your clinic keeps it for as long as it is legally required to. Deleting an app cannot erase a medical record, and no health app can honestly promise otherwise.

We may suspend or close your account if you break these terms, or if we have to for legal or security reasons.

Governing law

These terms are governed by the laws of India. The courts at [CITY] have exclusive jurisdiction. [DECIDE: arbitration clause or courts only — and check enforceability against consumers]

Nothing here stops you using the consumer forums available to you under Indian law.
